At present, business formalities are carried out by a number of different players, including :
- Chamber of Commerce and Industry (CCI);
- Chambre de Métiers et de l'Artisanat (CMA);
- Chamber of Agriculture (CA) ;
- Greffe du Tribunal de Commerce ( GTC),
- Union de Recouvrement des cotisations de Sécurité Sociale et d'Allocations Familiales (URSSAF),
- Or the Direction Générale des Finances Publiques (DGFIP).
From January 1, 2023
All companies will be required to declare the formalities involved in setting up, modifying or closing down their business, and to file their annual accounts via the Guichet électronique des formalités d'entreprises (otherwise known as the "Guichet unique").
The Guichet unique platform designed by the interministerial mission to simplify and modernize business formalities has been developed by the Institut National de la Propriété Industrielle (INPI), which will become the single point of contact for businesses from January1, 2023.
The electronic formalities counter will be the single access point for all your formalities.
Expected objectives :
- Simplification of business procedures through a single player(INPI);
- Widespread dematerialization of formalities ;
- Unification of existing registers (National Trade and Companies Register, National Trades Register and Agricultural Assets Register);
- The creation of a national register of companies (RNE) supplied by INPI.
This implies :
- The eventual disappearance of the Infogreffe website;
- The disappearance of physical and, if necessary, telephone reception services at commercial court registries and CFEs (Centres de Formalités): CCIs, CMAs and CAs;
- The disappearance of paper-based formalities;
- Payment of the formalities fees inherent in the transaction in question, as soon as we sign our engagement letter, so that our firm can manage the payment of said fees directly once the formalities in question have been entered into the Guichet unique.
Under this new process, legal departments are responsible for tasks that were previously handled by the Centres de Formalités.
As with any new system, there will be a period of adjustment for all those involved.
To date, the platform is still evolving, following the appearance of operational malfunctions.
From January1, 2023 and for an indefinite period, processing times for formalities filed will be uncertain and potentially lengthened.
