Economic and social resilience plan

General measures

• PGE of up to 35% of sales for companies particularly hard hit by the consequences of the crisis in Ukraine
  Terms to be defined in the coming days following discussions with the European Commission
• Prêt Croissance Industrie (BPI) open to construction companies
• Re-subsidized growth loan (BPI)
• State subsidized loans extended to fin 2022 (CODEFI)
• New state-guaranteed liquidity facility for companies affected by the crisis in Ukraine and its economic consequences (from the second half of the year) - Details to be discussed with the European Commission, French companies and banks.

• Possibility of extending the APLD for up to 12 months for agreements already signed
• Possibility of negotiating LTIP agreements until December 31, 2022 instead of June 30, 2022
• Possibility of adapting the terms of an LTIP agreement throughout its duration to take account of changes in the company's economic situation during the crisis.
• State services to support branches and companies that are not yet covered and wish to negotiate an agreement very quickly.

It is now easier to defer or arrange payment of social security and tax obligations.

Businesses in difficulty as a result of rising energy prices can turn to the DGFiP and URSSAF services (via their online space), as well as the MSA, departmental crisis exit advisors and the dedicated emergency measures number (0806 000 245).

Support for the most exposed sectors

• Help for livestock farmers severely affected by the rise in feed costs, to offset part of their lost margins over 4 months from April 1, up to the limit of the farm's losses.
• Mechanism for declaring and then reimbursing TICPE in advance, in addition to the 15-centime fuel rebate applicable from April 1 on agricultural GNR.
• Support to promote solidarity in the agri-food industry, as well as trade negotiations & mediation (increase in controls vis-à-vis the EGAlim 2 law, Mediation of agricultural trade relations, Committee for the settlement of agricultural trade disputes...).

• Road hauliers, cabs and VTCs eligible for the "15 centimes" fuel discount.
• Additional aid for losses incurred in recent weeks and up to April 1 (amount to be determined in the next few days).

For road haulage and passenger transport companies (excluding cabs):

• Partial reimbursement of Taxe intérieure de consommation sur les produits énergétiques (TICPE) on their fuel consumption accelerated on a monthly basis.
• Facilitated deferral or payment of social security and tax obligations.
• Tighter controls to ensure that variations in fuel prices are taken into account in transport contracts, and work with the National Road Committee to revise price indices.

For cab operators :

• Acceleration of partial TICPE refunds once applications have been submitted,
• Ceiling on fares to be updated shortly (including for patient transport by licensed cab).
• Postponement of the age limit for VTCs (initially scheduled until early August) extended until the end of the year.

For sea transport :

• Acceleration of France Recovery Plan measures

• Public procurement: The government will ask public bodies to apply the theory of unforeseeability whenever possible to public procurement contracts that do not include a price revision clause, and to waive penalties for late delivery when this is justified by a supplier's extension of a delivery deadline due to the crisis.
• Private law contracts : in principle, the theory of unforeseeability applies (unless the contracting parties have decided otherwise), in which case contract renegotiation is possible if a change in circumstances unforeseeable at the time the contract was concluded makes performance of the contract excessively onerous for a party who had not agreed to assume the risk.
• Faster publication of building indexes,
• Under the aegis of the prefect, building and civil engineering crisis units bringing together professional federations from the sector, local distributors and manufacturers, and public and private contractors, will be activated to provide a forum for dialogue on issues of concern to the sector.
• Public works activity (Applicable measure - Decree of 05/04/2022) : subsidy of 0.125% of sales in calendar year 2021 (capped at €200,000). Conditions to be met:
  • Company created before 01/01/2022 with fewer than 250 employees, sales of less than €50 M and a balance sheet total of less than €43 M
  • Main activity in the Public Works sector according to a list annexed to the Decree
  • Operating public works equipment
  • Not be in safeguard, receivership or liquidation proceedings
  • Have no unpaid tax or social security debts on 12/31/2019
  • Dematerialized application on impots.gouv.fr until June 30, 2022.

Support for exporting and energy-intensive companies

• Setting up contact points within Team France Export (TFE)
• Extension of the "Cap Francexport" program, as well as the "Relance Export" and "VIE" vouchers until fin 2022.

• This applies to companies whose gas and electricity expenditure represents at least 3% of sales, and which will be loss-making in 2022 as a result of rising energy costs.
• Subsidy of half the excess energy costs, enabling them to reduce their losses by up to 80% (capped at €25 million).
• No size or sector requirements

Implementation as soon as possible for the period March 1 to December 31, 2022.

Other aids

• Setting up new partnerships with trusted third countries
• Implementation of the previous "France Relance" and "France 2030" plans to reduce our dependence and take better account of social and environmental externalities.
• Creation of a cross-functional working group on strategic sourcing to define the most appropriate short-term solutions, complemented by specific work on the most critical inputs (aluminum, titanium, palladium and platinum, rare gases, tungsten).
• A cross-disciplinary call for expressions of interest has been launched, with the aim of supporting all projects that address Russian strategic dependence.

• Creation of an energy crisis committee led by the Médiateur des Entreprises,
• Extending the role of the Médiateur des entreprises to cover tensions in the industry caused by energy shortages and cost rises.

In order to strengthen our energy, food and industrial sovereignty, and thus reduce our dependence, and take better account of our social and environmental externalities, a number of initiatives have been launched.
