A decree and order dated March 30, 2018 finalized the experimental "emplois francs" scheme, applicable to employment contracts signed between April1, 2018 and December 31, 2019.

Employers and employees concerned by "emplois francs

Companies that hire jobseekers living in priority urban priority urban policy districts can benefit from a bonus paid over several years.

The decree lists the priority neighborhoods for city policy (QPV). They are as follows:

  • the entire Seine-Saint Denis department;
  • the conurbations of Roissy Pays de France and Cergy-Pontoise in the Val d'Oise;
  • the Grand Paris Sud Seine Essonne Sénart territory, including Évry and Grigny in Essonne and Seine-et-Marne;
  • Lille European Metropolis (MEL);
  • the Aix-Marseille-Provence metropolis;
  • the urban community of Angers Loire Métropole.

PLEASE NOTE : The logic behind "emplois francs" is based on the person recruited. It is therefore the employee's place of residence that counts, not the address of the company or association recruiting him or her.

Jobseekers must be registered with Pôle Emploi in category 1, 2, 3, 6, 7 or 8 (according to the decree, these correspond to statistical categories A, B and C).

To qualify for assistance, a number of basic conditions must be met:

1. Be up to date with all declarations and payments to the tax authorities and organizations responsible for collecting social security and unemployment insurance contributions,

2. The employee has not been made redundant in the 6 months prior to hiring,

3. Do not hire a person who has been with the company for 6 months prior to the date of hire.

Amount of assistance

The aid is set as follows:

  • 5,000 euros per year for up to three years for permanent hires
  • 2,500 euros per year for up to two years for a fixed-term contract of more than 6 months

The amount of aid is prorated according to the actual duration of the employment contract, if the employment contract is interrupted during the calendar year, and the weekly working time, if this is less than full-time. It also takes into account any periods of absence by the employee for which remuneration has not been maintained.

Formalities

Employers must submit their application to Pôle emploi within two months of signing the employment contract, via an online service.

For a period of four years from the date the aid is granted, the employer must provide Pôle emploi with all documents required to check the eligibility of the aid.

Payment of aid

State aid is due from the first day of performance of the employment contract, and is paid on a half-yearly basis (every 6 months).

Each payment is made on the basis of a certificate from the employer, sent to Pôle emploi, justifying the employee's presence.

This certificate must mention any periods of absence for which the employee was not entitled to continued remuneration.

Failure to produce a certificate of attendance within two months of the end of each six-month period of contract performance will result in the permanent loss of entitlement to aid for that period.

Note: when the amount due to the employer is less than 100 euros for a half-year, Pôle emploi will not pay it.
