Companies with over 50 employees are required to calculate and publish their gender equality index for the previous year by March1 of each year.
This index takes the form of a score calculated out of 100 points, based on 4 or 5 indicators (depending on the size of the company) relating to the pay gap between men and women.
If the company achieves a result of less than 75 points, it must take corrective measures to reduce the discrepancies within 3 years.
The overall score and the results obtained for each indicator must :
- be published visibly and legibly on the company's website, if one exists, or otherwise be brought to the attention of employees by any means ;
- be submitted to DREETS via https://index-egapro.travail.gouv.fr/
- be made available to the Comité Sociale et Economique (CSE) via the BDESE.
Failure to publish results, implement corrective measures or demonstrate inefficiency may result in a financial penalty of up to 1% of payroll.
